On October 31, 2007, tied to its spin-off from Peabody Energy, Patriot signed a four-year, $500 million revolving credit facility with Bank of America as agent (including a $50 million swingline and a letter of credit sub-facility). It is secured by substantially all assets of Patriot and its domestic subsidiaries and becomes available only once the spin-off, a special dividend of Patriot shares to Peabody shareholders, is completed.
